Artificial intelligence has moved from isolated experimentation to enterprise integration. As organizations incorporate AI systems into core operational, financial, and legal workflows, governance structures that once operated in the background are being tested in new and unfamiliar ways. In this seven-part series, Where Legal Must Lead: The Seven Pressure Points of AI Governance, we examine the areas in which the legal department’s leadership is essential. This first article examines the interpretive function of the legal department in the evolving landscape of AI regulation.
As artificial intelligence systems move from pilot projects into operational deployment, regulatory scrutiny has intensified. Although the United States has not enacted a single comprehensive federal AI statute, a growing constellation of federal guidance, state-level legislation, sector-specific regulatory expectations, and international regimes such as the European Union AI Act, has reshaped the compliance environment. In parallel, governance frameworks such as the NIST AI Risk Management Framework and IOS/IEC 42001 have gained prominence as reference models for structured AI deployment and oversight. The result is not regulatory uniformity, but regulatory density.
In this environment, the legal department serves as the enterprise’s interpretive authority. Its responsibility is to analyze evolving laws, regulations, directives, and governance frameworks and translate them into structured guidance that informs AI adoption decisions. That interpretive function requires disciplined analysis of how specific AI use cases intersect with statutory classifications, disclosure obligations, documentation requirements, audit expectations, and enforcement posture.
AI governance obligations are contextual. They turn on the nature of the system, the function it performs, the data it processes, the populations it affects, and the organization’s role in development or deployment. A system used to assist internal knowledge management presents different legal considerations than one used to influence employment decisions, credit determinations, or healthcare outcomes. Determining how those distinctions apply is a legal analysis grounded in statutory interpretation and regulatory guidance.
As AI governance frameworks gain adoption, Legal also plays a central role in advising how those frameworks should be incorporated into enterprise compliance structures. Technical and compliance teams may operationalize controls mapped to the NIST AI Risk Management Framework or pursue certification under ISO/IEC 42001. The legal department’s responsibility is to interpret how those frameworks interact with statutory obligations, contractual commitments, and fiduciary duties. Legal ensures that governance adoption reflects regulatory expectations rather than mere procedural alignment.
AI risk impact assessments further illustrate the legal department’s interpretive mandate. Technical teams may conduct model testing and bias analysis. Compliance teams may administer documentation workflows. The legal department determines when such assessments are legally required, interprets the substantive elements necessary to satisfy regulatory standards, and advises leadership on the legal implications of the findings. Legal collaborates with IT, Compliance, Risk, and business stakeholders to ensure that regulatory requirements are integrated into the organization’s governance architecture at the appropriate stage of adoption.
Regulators increasingly evaluate not only whether harm occurred, but whether governance structures existed before deployment. Organizations that implement AI without structured legal interpretation often discover that classification errors, incomplete documentation, or misaligned oversight mechanisms have created avoidable exposure. By engaging at the design stage of AI adoption, the legal department ensures that implementation decisions reflect regulatory realities and institutional risk tolerance.
Interpreting and applying emerging AI regulation is therefore a foundational governance responsibility. Through disciplined legal analysis and structured collaboration, the legal department defines the regulatory perimeter within which AI must operate. In an environment characterized by accelerating adoption and evolving standards, that interpretive leadership is essential to institutional accountability and sustainable enterprise decision-making.
